Justice Torkornoo Drags Ghana to ECOWAS Court Over Suspension

Suspended Chief Justice, Her Ladyship Justice Gertrude Torkornoo, has initiated a new legal case against the Republic of Ghana at the ECOWAS Community Court of Justice in Abuja, Nigeria. This action challenges her ongoing suspension and accuses the state of several human rights violations. The Deputy Attorney-General and Minister of Justice, Dr. Justice Srem-Sai, confirmed the development on Tuesday via his Facebook page, noting that the case was officially filed on July 4.
“I can confirm that the Chief Justice—Her Ladyship, Justice Gertrude Torkornoo—has filed another court case, this time at the ECOWAS Community Court in Abuja, Nigeria, against the Republic,” Dr. Srem-Sai wrote.
He explained that the ECOWAS suit echoes the claims of human rights breaches already being argued in cases currently before Ghana’s Supreme Court and High Court. These legal matters all stem from the removal proceedings being carried out against the Chief Justice.
Justice Torkornoo contends, according to the Deputy Attorney-General, that her suspension amounts to a de facto removal from office without a conclusive ruling. She argues that this violates her constitutional right to carry out the duties of the position to which she was legitimately appointed.
